PTSD Guide - Part 6

A Veteran will receive a rating decision from the VA when they have made a decision on the Veterans claim.  The VA decision letter will state if the Veterans claim is service-connected or denied.  If the Veteran is service-connected then the rating decision will also state whether the Veterans claim for TDIU is awarded or denied.

If the Veterans claim for PTSD or TDIU based on PTSD is denied they only have one year from the date the decision was made to file an appeal.  

If the Veteran receives a denial, they then need to figure out what the problem is that caused the denial.  Within the VA rating decision it goes into detail about why the VA made a the decision that they did.  Here are a few examples of what could have caused a denial:

  • No current diagnosis - not having a proper official diagnosis of PTSD prior to the C&P exam
  • Insufficient evidence - unable to verify the Veterans stressor
  • Missing records - the VA does not have your private doctors records or missing a DD214 (if Veteran has multiple)
  • Eligibility requirements - the Veteran does not qualify for VA benefits

It might be evident that the VA benefits process can be long and very frustration for Veterans, as their claim moves up and down the VA claims process, through appeals, and even remands.  Hopefully, our Guide to PTSD, can help prepare the Veteran and assist them with the knowledge to properly navigate the VA claims process.
